1. Reservations

1.1 How to Make a Reservation
To book any of our exclusive programs or tours:

  1. Go to the “Online Booking” section on our official website.

  2. Select your preferred tour and carefully read the Booking Terms and Conditions.

  3. Complete and submit the Booking Form available on the site.

  4. Within a maximum of 48 business hours, you will receive an email confirming or rejecting your request.

  5. If confirmed, we will send you detailed instructions for the corresponding deposit payment.

1.2 Required Personal Information
To finalize your reservation, we will need the following details:
• Full name
• Passport number
• Date of birth
• Nationality

This information is essential to process permits and tickets for tourist sites such as Machu Picchu, national parks, and other locations requiring prior authorization.


2. Payments

2.1 Deposit
To secure your reservation, we require a minimum deposit of 50% of the total tour cost. You may choose to pay 100% upfront if you wish to fully guarantee your experience.

2.2 Remaining Balance
The pending balance must be paid before the service date, which will be confirmed in the booking email. If payment is not completed within the established timeframe, the reservation may be canceled with no refund of the deposit.

2.3 Payment Methods
We accept various payment methods:
• Bank transfer
• Credit/debit cards
• Secure online payment gateways


3. Changes, Cancellations, and Refunds

3.1 Changes by the Client
• Minor changes (dates or number of participants): No extra cost, as long as they do not involve new services.
• Major changes (itinerary modifications, additional services): May incur extra charges, to be covered by the client.

3.2 Cancellations by the Client
Cancellations must be submitted via email or through our online platform. The following penalties apply:
• More than 30 days before the tour: 30% of the total cost
• Between 30 and 21 days: 50%
• Between 20 and 11 days: 75%
• 10 days before or on the day of the tour: 100%

3.3 No Show
If the client does not show up on the day of the tour without prior cancellation, a 100% penalty will be applied.

3.4 Cancellation by GMAX LUXE TRAVEL

We reserve the right to cancel a tour in the event of:
• Non-payment of the remaining balance
• Force majeure: natural disasters, civil unrest, strikes, government decisions, or extreme weather conditions

We will offer similar alternatives or the corresponding refund if the client prefers, excluding expenses already incurred such as non-refundable tickets or entry fees.

3.5 Refunds

If a refund applies, it will be processed within up to 30 business days, deducting any applicable bank fees or administrative costs. Refunds will only be made to the original payment method.


4. Responsibilities and Risks

4.1 Acceptance of Risks
By booking, the client acknowledges that some destinations or activities involve inherent risks (accidents, illness, adverse weather, etc.). GMAX LUXE TRAVEL is not liable for personal injury, losses, or incidents beyond its direct control.

4.2 Guide Authority
During the activity, the guide or company representative has full authority regarding the safety and well-being of the group. The client agrees to follow instructions and all applicable local regulations.


5. General Conditions

5.1 Participation Requirements
Some tours may have specific physical requirements (minimum age, weight, physical condition). GMAX LUXE TRAVEL reserves the right to deny participation if the client does not meet these requirements, without the right to a refund.

5.2 Travel Documentation
It is the client’s responsibility to have:
• A valid passport
• Required visas
• Any documents required by local authorities

No refunds will be issued if the client cannot participate due to a lack of valid documentation.


6. Promotions and Discounts

• Promo codes must be applied at the time of booking.
• They are not cumulative and cannot be refunded in cash.
• In case of cancellation, only the amount actually paid will be refunded.


7. Changes to Terms

We reserve the right to update or modify these Terms at any time. Any modifications will take effect immediately upon their publication on our website www.gmaxluxetravel.com. Continued use of the site or services by the Explorer constitutes full acceptance of such changes.
It is the Explorer’s responsibility to periodically review the current Terms and Conditions. Updated versions will include the date of the last modification for the user’s reference.


8. Prohibited Activities

The Explorer agrees not to engage in any prohibited activity, including but not limited to:
• Providing false information
• Using the Service for any unlawful purpose
• Distributing viruses or other harmful code
• Interfering with the operation of the Service
• Violating any law or third-party rights


9. Intellectual Property Rights

9.1 Intellectual Property
All content, features, and functionality on the Site—including text, graphics, logos, icons, and images—are the exclusive property of GMAX LUXE TRAVEL or its content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9.2 Use of Content
These Terms permit the Explorer to use the Site exclusively for personal, non-commercial purposes. The Explorer may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any material from the Site, except in the following cases:

  • The Explorer’s computer may temporarily store copies of such materials in RAM incidental to accessing and viewing those materials.

  • The Explorer may store files that are automatically cached by their web browser for display enhancement purposes.

9.3 Trademarks
The name, logo, and all related names, logos, product and service names, designs, and slogans of GMAX LUXE TRAVEL are trademarks of GMAX LUXE TRAVEL or its affiliates or licensors. The Explorer may not use such marks without prior written permission from GMAX LUXE TRAVEL. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

10. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by GMAX LUXE TRAVEL. GMAX LUXE TRAVEL has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. The Explorer acknowledges and agrees that GMAX LUXE TRAVEL shall not be held responsible, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly recommend that the Explorer read the terms and conditions and privacy policies of any third-party websites or services they visit.


11. Disclaimer of Warranties

The Services and all content, products, and services included or made available to the Explorer through the Site are provided by GMAX LUXE TRAVEL “as is” and “as available,” unless otherwise specified in writing. GMAX LUXE TRAVEL makes no representations or warranties of any kind, express or implied, regarding the operation of the Services, the content, or other products or services included or made available to the Explorer through the Services, unless otherwise specified in writing. The Explorer expressly agrees that the use of the Services is at their own risk.


12. Limitation of Liability

To the fullest extent permitted by applicable law, GMAX LUXE TRAVEL and its affiliates and suppliers shall not be liable for any loss, damage, or injury of any kind, including but not limited to direct, indirect, incidental, punitive, and consequential damages arising from the use of the Services or from any information, content, materials, products (including software), or other services included or made available to the Explorer through the Services. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if GMAX LUXE TRAVEL has been advised of the possibility of such damages), resulting from:
(i) the use or inability to use the Service;
(ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained, or messages received or transactions entered into through or from the Service;
(iii) unauthorized access to or alteration of the Explorer’s transmissions or data;
(iv) statements or conduct of any third party on the Service; or
(v) any other matter related to the Service.

13. Indemnification

The Explorer agrees to defend, indemnify, and hold harmless GMAX LUXE TRAVEL, its affiliates, and their respective directors, officers, employees, contractors, agents, licensees, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to the Explorer’s violation of these Terms or use of the Services, including, without limitation, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or the use of any information obtained from the Site.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Peru, without regard to its conflict of law principles. The Explorer agrees that any dispute arising out of or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction and venue of the courts of Peru.

15. Dispute Resolution

15.1 Informal Resolution
In the event of any controversy, claim, or dispute arising out of or relating to these Terms or their breach, the parties shall attempt, promptly and in good faith, to resolve such controversy. If they are unable to resolve it within a reasonable time (not to exceed thirty (30) days), either party may submit the matter to mediation.

15.2 Mediation
If the dispute is not resolved through mediation within sixty (60) days of the commencement of such proceedings, it shall be resolved through binding arbitration in accordance with the commercial arbitration rules of the relevant arbitration body in Peru. The arbitral award may be entered in any court of competent jurisdiction.

16. Waiver and Severability

16.1 Waiver
No waiver by GMAX LUXE TRAVEL of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of GMAX LUXE TRAVEL to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

16.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court or other tribunal of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

17. Entire Agreement

These Terms constitute the sole and entire agreement between the Explorer and GMAX LUXE TRAVEL regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

20. Force Majeure

GMAX LUXE TRAVEL shall not be liable to the Explorer or any other participant for losses, delays, cancellations, or any type of non-performance occurring during the trip, before or after the provision of the service, as a result of causes beyond our reasonable control.
This includes, but is not limited to:

  • Technical failures, interruptions in communication or power services.

  • Cyberattacks, computer viruses, unauthorized access.

  • Natural disasters, extreme weather conditions, earthquakes, pandemics, epidemics, health or public health crises.

  • Labor disputes, strikes, civil unrest, wars, or armed conflicts.

  • Government restrictions, political decisions, or unexpected closures of tourist services or access areas.

This clause applies even if GMAX LUXE TRAVEL must cancel an activity on the same day or during its execution. In such cases, the Explorer shall not be entitled to refunds or financial compensation, nor may they make claims against third parties contracted by GMAX LUXE TRAVEL to carry out the service.

21. Governing Law, Jurisdiction, and Arbitration

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Peru, applicable to contracts made and performed in said country.

  • Exclusive Jurisdiction: Any dispute that cannot be resolved amicably shall be submitted to binding and confidential arbitration in accordance with the rules of commercial arbitration in Peru.

  • Arbitration shall take place in Peruvian territory.

  • Any claim must be handled individually and shall not be combined with any class action.

  • Each party shall bear 50% of the arbitration costs and be responsible for their own legal expenses.
    The only exceptions to this arbitration clause are claims related to the Explorer’s violation of intellectual property rights.

22. Severability

If any clause of these Terms is declared invalid or unenforceable by a competent court or the appointed arbitrator, such clause shall be removed or modified to the minimum extent necessary. The remainder of the Terms shall remain in full force and effect.

23. Assignment

GMAX LUXE TRAVEL reserves the right to assign or transfer its rights and obligations under these Terms to third parties without the prior approval of the Explorer. This may include asset sales, mergers, corporate restructurings, or other business decisions.
